ACCEPTANCE OF TERMS

Virtools SA makes available for your use the Volcano Racer Web Kit, subject to the terms and conditions set forth in this document (the "Terms of Use"). By accessing or using this Web Kit, you agree to the Terms of Use. Virtools SA reserves the right to change the Terms of Use from time to time at its sole discretion. Your use of the Volcano Racer Web Kit will be subject to the most current version of the Terms of Use posted on the Site at the time of such use. If you breach any of the Terms of Use, your authorization to use this Site automatically terminates and you must immediately destroy any materials downloaded or printed from the Site. Please read this agreement carefully.

COPYRIGHT: LIMITED LICENSE

The content represented in this Web Kit is protected by copyright and/or other intellectual property laws and any unauthorized use of the material available on Volcano Racer Web Kit may violate such laws. Except as expressly provided herein, Virtools SA and its suppliers do not grant any express or implied right to you under any patents, copyrights, trademarks, or trade secret information with respect to the material in this Web Kit.

TERMS OF USE

Use of this software

Upon your acceptance of this agreement, Virtools grants you a non-exclusive license to use this software. You may install this software on a hard disk or other storage device and/or make backup copies. You may also make and distribute unlimited copies of this software, as long as each copy that you make and distribute contains this agreement and the same copyright and other proprietary notices pertaining to this software that appear in the software.

Ownership

This license agreement gives you limited rights to use the software. You do not become the owner of, and Virtools SA retains title to, this software, and all copies thereof. All rights not specifically granted in this agreement are reserved by Virtools SA.

Restrictions

1.Virtools SA declines all responsibility for any software and/or hardware crashes.
2. Free installation of Volcano Racer is permitted, but you agree not to modify, adapt, translate, reverse engineer, decompile, disassemble or reuse any part of it, in any way, shape or form.
3. You agree not to attempt to bypass or remove the banner ad.
4. You agree not to claim any property of Volcano Racer.

No Warranty

This software is delivered to you AS IS and Virtools SA makes no warranty as to its use or performance. Virtools SA and its suppliers do not and cannot warrant the performance or results you may obtain by using this software. Virtools SA and its suppliers make no warranties, express or implied, as to non-infringement of third party rights, merchantability, or fitness for any particular purpose. In no event will Virtools SA or its suppliers be liable to you for any consequential, incidental or special damages, including any lost profits or lost savings, even if a Virtools SA representative has been advised of the possibility of such damages, or for any claim by any third party.

Governing Law

This contract is governed and construed in accordance with French law. You agree that any dispute shall be submitted to the jurisdiction of Paris, France.
